Understanding The Texas Liquor Law

There are many differences around the state of Texas when it comes to the liquor law. Of course, there are standards that have been set by the laws of the state, but each county and even municipality has the ability to make the law even more stringent. This can make it very confusing for those that wish to open a liquor store or bar but aren’t sure of what laws apply where they are.

This is an old law that resulted from the push that all occupants of the state should spend the day doing religious activities. There are many who are now fighting to change such laws as they are based on religion, and in some cases, they heavily favor the interests of special interest groups.

A Texas liquor law that isn’t well known, and seems to counter some of the other laws that are in place, is that minors can legally drink in the state. Texas is one of only 10 states that still allow minors to consume alcohol. The contingency is that the alcohol has to be provided to them by a legal guardian or parent, or under their parent’s permission. In that situation, the parent then becomes completely responsible for the actions of the minor while they are consuming alcohol. However, to drink in public, you do have to be 21 years of age or older.

Finally, one law that is important to note, that differs slightly from those in other parts of the country, is regarding having an open container in the vehicle. In most states, it is only illegal to have an open container if the vehicle is in motion. This is not the case in Texas. Any open container is illegal unless it is in a locked trunk or glovebox. Of course, this begs the question of how you get it to or from either place without breaking the law, but as you likely know, not all laws make complete sense.
